1. Introduction
Welcome to SDIO Co., Ltd. (“we,” “our,” or “us”). We respect your privacy and are committed to protecting your personal data. This privacy policy will inform you about how we look after your personal data when you visit our website and tell you about your privacy rights and how the law protects you.
2. The Data We Collect About You
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:
- Identity Data includes first name, last name, username or similar identifier.
- Contact Data includes billing address, delivery address, email address and telephone numbers.
- Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
- Usage Data includes information about how you use our website, products and services.
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
3. How We Use Your Personal Data
We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
- Where we need to perform the contract we are about to enter into or have entered into with you.
- Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
- Where we need to comply with a legal obligation.
- Where you have given us consent to contact you for a specific purpose (for example, SMS and WhatsApp marketing messages — see Section 4).
4. SMS and WhatsApp Communications
If you provide your phone number on our waitlist and affirmatively opt in to the consent statement shown at that point, we will send you your early-access invite from Fabl by SMS or WhatsApp. Because real users don't always see the first message, the consent also covers up to two follow-up reminders if you have not responded to the initial invite. Reminders cover the same subject matter (your invite) and are sent at most a few days apart; we will not send more than three invite-related messages in total.
If you wish to receive ongoing updates, product news, or marketing from Fabl after the invite, we will give you a separate opportunity to opt in — typically by replying YES (or similar) to the invite message itself. We will never send you messages that go beyond the scope of your consent.
Program details.
- Sender: SDIO Co., Ltd., operating as Fabl.
- Channels: SMS and WhatsApp.
- Content: your early-access invite from Fabl, plus up to two reminders of that invite if you have not responded. Any further communication requires a separate opt-in.
- Frequency: a maximum of three invite-related messages per waitlist sign-up, spaced at most a few days apart. Any additional messages would require fresh consent.
- Cost: standard carrier message-and-data rates may apply. Neither SDIO Co., Ltd. nor the mobile carriers are liable for delayed or undelivered messages.
- Opt-out: reply STOP to any message, or email hello@sdio.ai, to be removed. A STOP reply is absolute — we will not send any further messages, including reminders. Withdrawing consent does not affect the lawfulness of any processing already carried out.
- Help: reply HELP to any message or email hello@sdio.ai.
Lawful basis. We rely on your consent. Two legal regimes apply in parallel: under the UK GDPR and EU GDPR, consent (Article 6(1)(a)) is our lawful basis for processing your phone number in order to deliver the invite; under the UK Privacy and Electronic Communications Regulations (PECR Regulation 22) and the EU ePrivacy Directive, consent is our lawful basis for actually sending you the electronic message. The same affirmative opt-in also satisfies Canada's express consent requirement under the Anti-Spam Legislation (CASL, S.C. 2010 c. 23, sections 6 and 10) and the United States' prior express consent requirement under the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227 and 47 C.F.R. § 64.1200).
How consent is captured. When you provide your number, a concise disclosure identifying us as the sender, the purpose (delivering your invite), and the channels (SMS and WhatsApp) is shown next to an unchecked checkbox. Ticking that box is your affirmative, specific, informed consent. You may withdraw it at any time, for any reason, without detriment, by replying STOP to any message we send or by emailing hello@sdio.ai. Withdrawing consent does not affect the lawfulness of processing we already carried out on the basis of your consent.
Consent records. We record the exact wording you saw, the version of that wording, the timestamp of your consent, the channels covered (SMS and WhatsApp), the user-agent string of your device, and the IP address of your submission. We retain these records for as long as you remain subscribed and for up to four years after you opt out, in order to meet statutory limitation periods under US, Canadian, UK and EU law.
5. Data Security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
6. Data Retention
We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. Records of consent to electronic marketing are retained as described in Section 4.
7. Your Legal Rights
Under certain circumstances, you have rights under data protection laws in relation to your personal data, including the right to access, correct, erase, restrict, transfer, or object to processing of your personal data, and the right to withdraw consent to electronic marketing at any time.
